§ 93.02. AREAS WHERE KEEPING PROHIBITED.

  • (A) No horses, cattle, sheep, pigs or goats shall be kept in the city except upon the application or receipt of a conditional use permit in the manner specified in the Zoning Code.
    (B) Persons exempt from this section are persons who on a continuing basis have farm animals on their property. If they discontinue animals for 12 consecutive months they are no longer exempt.
    (C) The Council shall not issue a permit unless it determines:
    (1) The permit and use would not create a nuisance or hazard;
    (2) Diminish the fair market value of the surrounding properties;
    (3) Unless the applicant has a confinement area of a minimum of 2 acres; or
    (4) The permit and use would not be inconsistent or contrary to any other part of this chapter.
