§ 92.07. UTILITY AND LIGHT POLE.

  • (A) No person shall erect any pole in any street or public grounds without first complying with the provisions of § 92.01 through this section.
    (B) Every pole in the streets and public grounds of the city, whether erected hereafter under a permit or heretofore, shall be subject to the control of the Council, and shall be removed when so ordered by the Council, at the expense of the owner.
    (C) (1) All poles erected in the streets or public grounds shall be available for supporting wires of any franchise holder having occasion to string wires in the streets and public grounds.
    (2) Every subsequent user of the poles shall pay upon demand to the prior owner his or her equal share of cost thereof, or rental thereof.
    (D) The purchase, erection or maintaining of any pole on the streets or other public grounds in the city shall constitute an agreement to all provisions of this subchapter.
